Frucor Suntory New Zealand Limited originally registered a particular colour green (Pantone 376c) as a trade mark on August 29th 2008, almost nine years ago, and are widely known to use this green colour on their V energy drinks.
Energy Beverages LLC, produces a drink marketed under the brand MOTHER and also desired to use this colour. In this case, Energy Beverages LLC applied to invalidate Frucor’s trade mark for this colour so that they may also use it on their products.
However, they were not successful and Frucor maintains their trade mark rights to the colour green for their drink products. You can read more about this case on the Intellectual Property Office of New Zealand website below.
